VISTO PER RESIDENZA ELETTIVA NOTA INFORMATIVA: Cittadino extracomunitario: cittadino la cui nazionalità appartiene a uno degli stati al di fuori della Comunità Europea. Tali soggetti hanno l’obbligo della titolarità di un visto, nei casi previsti dalla normativa, per l’ingresso nell’area Schengen (e quindi in Italia) per motivi di Turismo.

Visto:

è una autorizzazione per l’ingresso in uno stato da parte di cittadino straniero. Tale autorizzazione rilasciata sotto forma di sticker apposto sul documento di viaggio, è emanata dalla rappresentanza diplomatico – consolare dello stato nel quale il soggetto vuole fare ingresso. In tale documento è specificata l’area in cui è concesso l’ingresso, la durata, la motivazione.

Caratteristiche del visto per residenza elettiva:

consente l’ingresso in Italia allo straniero che intenda stabilirsi in Italia e sia in grado di mantenersi autonomamente, senza esercitare alcuna attività lavorativa.

Il visto per residenza elettiva consente l’ingresso per un soggiorno di lunga durata (superiore a novanta giorni) allo straniero che intenda stabilirsi in Italia e sia in grado di mantenersi autonomamente, senza esercitare alcuna attività lavorativa.

La durata del visto è di 1 anno e, come negli altri casi, entro 8 giorni dall’arrivo in Italia lo straniero deve richiedere il rilascio del rispettivo permesso di soggiorno alla Questura mediante il kit postale.

Il visto per residenza elettiva non consente lo svolgimento di attività lavorativa. Per richiedere il visto per residenza elettiva, lo straniero deve fornire adeguate e documentate garanzie circa la disponibilità di un’abitazione da eleggere a residenza, e di ampie risorse economiche diverse da proventi da lavoro, di cui si possa ragionevolmente supporre la continuità nel futuro.

Tali risorse debbono provenire, ad esempio, dalla titolarità di cospicue rendite (pensioni, vitalizi, ecc.), dal possesso di proprietà immobiliari, dalla titolarità di stabili attività economico-commerciali, da altre fonti diverse dal lavoro subordinato.

Il visto per residenza elettiva viene rilasciato se il richiedente dimostra di soddisfare il requisito economico minimo stabilito dalla normativa italiana, così come specificato nel Decreto Interministeriale MAE 850/2011.

In sostanza, il reddito minimo richiesto è di 31.000 euro l’anno per il singolo richiedente, ovvero, il triplo dell’importo annuo previsto dalla tabella A allegata alla direttiva del Ministro dell’interno del 1 marzo 2000 recante definizione dei mezzi di sussistenza per l’ingresso ed il soggiorno degli stranieri nel territorio dello Stato.

Al coniuge convivente, ai figli minori, ai figli maggiorenni conviventi e a carico, e ai genitori conviventi a carico del titolare di visto, potrà essere rilasciato analogo visto solo a condizione che le suddette capacità finanziarie siano adeguate. Pertanto, nel caso in cui il richiedente intendesse trasferirsi con il nucleo familiare, l’ammontare delle entrate mensili dovrà essere maggiorato di un 20% per il coniuge e di almeno un 5% per ogni figlio, sia quest’ultimo minorenne o maggiorenne a carico. L’Ambasciata italiana, nel caso in cui lo straniero acquisti un immobile a uso abitativo in Italia, riterrà implicita la sussistenza del “requisito economico minimo” stabilito dalla normativa italiana (31.000 euro/anno).

Negli altri casi, conformemente a quanto stabilito dalla normativa, la verifica della sussistenza dei requisiti è totalmente rimessa alla discrezionalità dell’Ambasciata.

Infine, lo straniero deve munirsi di un’assicurazione sanitaria internazionale (valida in tutti i Paesi Schengen) con una durata minima di 30 giorni e con una copertura minima di € 30.000 per le spese di ricovero ospedaliero d’urgenza e le spesse di rimpatrio.
Il visto per residenza elettiva è una fattispecie molto complessa che viene autorizzata a condizioni rigide. Recentemente, la giurisprudenza amministrativa si è mostrata piuttosto restrittiva nell’autorizzare l’ingresso dello straniero per residenza elettiva, precisando come, trattandosi per l’appunto di “residenza”, lo straniero debba dimostrare di voler effettivamente stabilirsi in Italia, posto che per residenza si intende luogo di stabile dimora.

Più precisamente, la sentenza Tar Lazio, sez. III-Ter, n. 7797 del 7 luglio 2016, ha affermato la legittimità del diniego del rilascio di visto di ingresso per residenza elettiva motivato dalla mancata dimostrazione circa la reale intenzione dell’interessato di vivere e risiedere in Italia permanentemente.

Infatti, scrive il giudice amministrativo, “il d.m. 11.5.2011 rimanda alla nozione di residenza effettiva, che è quella determinata dalla abituale e volontaria dimora di una persona in un determinato luogo, ossia dall’elemento obiettivo della permanenza in tale luogo e dall’elemento soggettivo dell’intenzione di abitarvi stabilmente”.

Tale interpretazione ha dunque inserito un nuovo requisito nella fattispecie, ossia la dimostrazione che il richiedente abbia una concreta e reale motivazione a stabilire in Italia la propria dimora abituale.
Solidità economica: è il requisito fondamentale e determinante ai fini della concessione del visto per residenza elettiva che deve essere determinata da un costante apporto finanziario da documentare attraverso dichiarazione dei redditi, titoli di proprietà immobiliari, attestazioni bancarie circa la disponibilità di risorse finanziarie, pensioni o vitalizi, stabili attività economico-commerciali.

Area Schengen: È l’insieme dei territori nazionali dei Paesi che applicano la Convenzione di Schengen. Gli accordi di Schengen fanno riferimento a un trattato che coinvolge sia alcuni Stati membri dell’Unione Europea sia stati terzi. Si può definire Schengen come una cooperazione rafforzata all’interno dell’Unione europea.

Rappresentanza diplomatico-consolare italiana: sede istituzionale del governo italiano all’estero. Tali enti sono dipendenti dal Ministero degli Affari Esteri.

Dichiarazione di ospitalità: dichiarazione scritta resa agli organi di pubblica sicurezza addetti. Tale dichiarazione è obbligatoria da parte di soggetto che offre ospitalità a un cittadino straniero extracomunitario entro 48 ore dall’inizio dell’ospitalità stessa.
