These Terms & Conditions (“Terms”) govern purchases, subscriptions, trials and services provided through AnyExpat.
Please read these Terms before purchasing, subscribing to or registering for an AnyExpat service. By completing a purchase or registration and accepting these Terms, you agree to be bound by them.
1. About These Terms
These Terms contain general provisions applying to AnyExpat transactions and services together with additional provisions applying to particular products, subscriptions or services.
Where you purchase, subscribe to or register for a particular AnyExpat product or service, the section of these Terms relating to that product or service forms part of your agreement with AnyExpat.
The specific price, trial period, subscription period, billing frequency and other commercial details presented to you at the time of sign-up or purchase also form part of your agreement.
Where a service-specific provision differs from a general provision in these Terms, the service-specific provision will apply to that service to the extent of that difference.
Additional service-specific sections may be added to these Terms as AnyExpat introduces additional products and services.
2. Acceptance of These Terms
You accept these Terms when you complete a transaction, registration or subscription through a process that requires you to acknowledge or accept them.
Where you are registering or purchasing on behalf of a company, partnership or other organisation, you confirm that you have authority to enter into the agreement on behalf of that organisation.
Electronic acceptance of these Terms, including acceptance through a payment or registration platform used by AnyExpat, constitutes acceptance of the agreement.
3. Information Provided at Sign-Up
The commercial details displayed to you during registration or purchase form part of your agreement with AnyExpat.
Depending upon the service, these may include:
the product or service being provided;
the applicable trial period;
the price;
the billing frequency;
the date on which payment becomes due;
the subscription period; and
any specific benefits or conditions applying to that service.
You are responsible for reviewing this information before completing registration or purchase.
4. Prices and Payments
Prices applicable to a particular service will be displayed or otherwise communicated before you complete your purchase or registration.
Payments may be processed by a third-party payment provider, including Stripe.
By providing a payment method, you authorise AnyExpat and its payment processor to use that payment method for amounts properly due under the service or subscription you have selected.
Unless expressly stated otherwise, prices are shown in the currency displayed during the transaction.
Any applicable taxes will be dealt with in accordance with applicable law and the information presented during the transaction.
5. Subscriptions
Where a service is provided on a subscription basis, the price and billing frequency will be shown before you subscribe.
Your subscription will continue in accordance with the billing arrangement accepted at registration until cancelled or terminated in accordance with these Terms.
Payments will be collected using the payment method associated with your account or subscription.
If a payment cannot be collected, AnyExpat may make further reasonable attempts to collect the amount due and may restrict or suspend the applicable service while payment remains outstanding.
6. Trials and Extended Trials
AnyExpat may provide free trial periods for certain services.
An “Extended Trial” means a free trial period of more than fourteen (14) days offered by AnyExpat.
The duration of your Extended Trial is the period clearly stated on the sign-up page at the time you register.
You may cancel your Extended Trial at any time before it ends. If you cancel during the Extended Trial, no subscription payment will be due.
No subscription fee is charged during the Extended Trial.
Unless cancelled before the Extended Trial ends, the service will continue as the paid subscription selected at sign-up, using the price, billing frequency and payment method agreed when you registered.
7. Cancellation
You may cancel an Extended Trial at any time during the trial period without charge.
Provided cancellation is completed before the Extended Trial ends, your paid subscription will not commence and no subscription payment will be due.
You may also cancel a paid subscription at any time. Cancellation of a paid subscription will take effect in accordance with the applicable subscription and billing period and will not affect payments that became due before cancellation.
AnyExpat will provide a reasonable method for requesting or completing cancellation.
Cancellation does not require you to provide a reason.
8. Renewal
Where a subscription automatically renews, the renewal period and billing frequency will be those disclosed and accepted when you subscribe.
Unless cancelled in accordance with these Terms, AnyExpat may collect the applicable renewal payment using the payment method associated with the subscription.

The following provisions apply where you register for an AnyExpat Property Partner service, including where you participate through an Extended Trial.

9. Purpose of the Property Partner Extended Trial
The Extended Trial allows your company to establish a presence with AnyExpat, begin advertising properties and experience the applicable AnyExpat services while AnyExpat transitions to its upgraded property platform.
The Extended Trial also provides an onboarding period during which your company can prepare for integration with the upgraded platform.
10. Initial Company Profile and Property Listings
Following registration, AnyExpat will establish your company on the current AnyExpat platform.
As part of the initial onboarding process, AnyExpat will create a company profile and may publish up to 10 properties supplied by your company or otherwise provided to AnyExpat with your authority.
These initial property listings are intended to establish your company’s presence on AnyExpat during the onboarding period.
The initial number of listings does not represent the maximum number of properties that may subsequently be displayed through the service following transition to the upgraded AnyExpat platform.
11. Transition to the Upgraded AnyExpat Platform
AnyExpat is developing an upgraded property platform.
When the upgraded platform becomes available for your company’s onboarding, AnyExpat will begin the process of transitioning your company profile and participating property advertising to the upgraded platform.
The timing and technical process of this transition will be determined by AnyExpat.
Features, presentation, functionality and technical integrations may change as the upgraded platform is introduced and developed.
12. XML Property Feed and Integration
As part of the transition to the upgraded platform, your company will be asked to provide access to a suitable XML property feed or another property-data feed or integration method agreed with AnyExpat.
Where your feed is technically compatible with the AnyExpat platform, AnyExpat will use the feed to facilitate the importing, displaying and updating of eligible properties.
Your company remains responsible for the accuracy and availability of property information contained within its feed and for ensuring that it has the necessary authority to advertise the properties supplied.
AnyExpat may exclude individual properties or content that is incomplete, duplicated, technically incompatible, inappropriate or otherwise unsuitable for publication.
Not every property contained within a supplied feed is required to be displayed by AnyExpat.
13. Services and Exposure Provided
AnyExpat provides participating Property Partners with access to its property advertising, company profile, international audience, community and related promotional facilities as applicable to the service.
The service is provided on an advertising and exposure basis. AnyExpat’s obligation is to provide the applicable services and opportunities for visibility, property promotion and customer engagement described within these Terms.
The level of engagement generated through advertising and exposure will naturally vary according to factors including property availability, location, pricing, market conditions and customer interest.
Any audience information, statistics or examples provided by AnyExpat are intended to describe the reach and nature of the AnyExpat network and do not form a commitment to a specific level of engagement or commercial activity.
An Extended Trial allows your company to experience these services, establish its presence within AnyExpat and complete the onboarding process for the upgraded property platform.
14. Enquiries and Customer Contact
AnyExpat will provide contact and enquiry facilities within participating company profiles and property listings, enabling interested users to make enquiries and contact participating companies.
Enquiries submitted through these facilities will be made available to your company using the contact details or enquiry-delivery method established for your account.
These facilities are designed to provide a direct connection between interested users and your company, allowing your team to respond to enquiries and develop the customer relationship directly.
Your company is responsible for responding to enquiries received through AnyExpat and for managing subsequent communication, advice, negotiations and transactions with prospective customers.
You agree to ensure that the contact information supplied to AnyExpat remains accurate and that genuine enquiries are handled professionally and in accordance with applicable laws and professional requirements.
15. Partner Information and Cooperation
You agree to provide AnyExpat with reasonable information and cooperation required to establish and maintain your participation in the service.
This may include:
company name and contact information;
company profile information;
company logo and branding;
property descriptions and photographs;
information required for the initial property listings;
access to or details of your XML or other property feed;
information reasonably required to configure or test your feed; and
notification of material changes affecting your company, property inventory or property feed.
16. Property and Content Responsibilities
You are responsible for ensuring that information supplied to AnyExpat about your company and properties is accurate to the best of your knowledge and kept reasonably up to date.
You must have the necessary authority to advertise properties supplied to AnyExpat.
You must also have the necessary rights or permissions to provide AnyExpat with photographs, property descriptions, company logos, trademarks and other content supplied for publication.
By supplying such material, you grant AnyExpat permission to use, reproduce, format, resize and display that material as reasonably necessary to provide and promote the AnyExpat service and your participation in it.
Properties that are no longer available should be removed from your feed or otherwise identified as unavailable within a reasonable period.
17. AnyExpat Communities
Where community participation is included within the service, participating companies may contribute to relevant AnyExpat communities and establish themselves as knowledgeable local property professionals.
Community participation is intended to connect members with participating companies through the AnyExpat platform.
When posting, commenting, responding to members or otherwise participating in AnyExpat communities, Property Partners must direct users to relevant content hosted on AnyExpat.com. This may include:
the Partner’s AnyExpat company profile;
the Partner’s property listings on AnyExpat;
articles or blog content hosted on AnyExpat;
contact or enquiry facilities provided through AnyExpat; and
other relevant pages, profiles, listings or content hosted on AnyExpat.
Property Partners must not post or publish links directing users to their own websites, property portals, landing pages, external property listings or other external destinations that bypass AnyExpat.
Where a Property Partner promotes a property, service, article or other relevant content within an AnyExpat community, the link must direct users to the relevant profile, listing, article or other content hosted on AnyExpat.com.
This requirement applies to links contained in posts, comments, replies and other community content published by or on behalf of a Property Partner.
Exceptions
Any exception to this requirement must receive prior written approval from AnyExpat.
An exception will apply only to the specific link, content, purpose or circumstances expressly approved by AnyExpat and does not create a general permission to publish other external links.
Verbal discussions, previous publication of an external link, or the absence of immediate moderation or removal by AnyExpat will not constitute approval.
Three-Strike Policy
AnyExpat operates a three-strike policy in relation to unauthorised external linking and attempts to bypass the AnyExpat platform.
Each identified breach may result in a warning or strike being recorded against the Property Partner’s account.
Upon a third breach, AnyExpat reserves the right to suspend or terminate the Property Partner’s account, community access and associated services.
Where a paid subscription is terminated following a third breach, AnyExpat reserves the right to retain subscription fees already paid for the current billing or subscription period, and no refund will be due for the remaining portion of that period, to the extent permitted by applicable law.
Termination will prevent future renewal charges once the applicable subscription has been terminated.
AnyExpat also reserves the right to suspend or terminate access immediately in the case of a serious, deliberate or abusive breach, fraudulent activity, or conduct that creates a material risk to AnyExpat, its platform or its communities.
AnyExpat may remove or edit links or content that do not comply with this section.
Community access must also be used responsibly. Companies must not use AnyExpat communities for spam, misleading advertising, repetitive unsolicited promotion or other activity that AnyExpat reasonably considers inappropriate or detrimental to its members or the operation of its communities.
AnyExpat may moderate, restrict or remove community content where reasonably necessary.
18. Compliance
Your company remains responsible for complying with laws, regulations, licensing requirements and professional obligations applicable to its business, services and property advertising.
AnyExpat may request information reasonably required to investigate an inaccurate listing, complaint, technical problem or potential breach of these Terms, and you agree to provide reasonable assistance where appropriate.
19. Platform Development and Availability
The Extended Trial provides access to the AnyExpat services available during the applicable stage of your onboarding.
Because AnyExpat is introducing an upgraded property platform, features, presentation, functionality and technical integrations may be introduced, changed or improved during the Extended Trial.
The availability of a particular feature or integration at the beginning of the Extended Trial does not mean that the same feature or integration must remain unchanged throughout the trial or subsequent subscription.
General Provisions
20. Intellectual Property
AnyExpat retains ownership of its websites, platform, branding, designs, software, databases, original content and other intellectual property belonging to AnyExpat.
Nothing in these Terms transfers ownership of AnyExpat intellectual property to a customer or Property Partner.
You retain ownership of content belonging to you.
Where you provide content to AnyExpat for use in connection with a service, you grant AnyExpat a non-exclusive permission to use, reproduce, display, format and distribute that content to the extent reasonably necessary to provide, operate and promote the applicable service.
21. Acceptable Use
You must not use AnyExpat services:
unlawfully or fraudulently;
to publish information you know to be materially false or misleading;
to infringe another person’s intellectual property or other legal rights;
to distribute malicious software;
to interfere with the operation or security of AnyExpat systems; or
in a manner reasonably considered abusive or harmful to AnyExpat, its users or other participating businesses.
22. Suspension and Termination
AnyExpat may suspend or restrict access to a service where reasonably necessary because of:
non-payment;
material breach of these Terms;
unlawful or fraudulent activity;
materially inaccurate or misleading content;
misuse of AnyExpat services or communities;
security concerns; or
conduct that creates a material risk to AnyExpat, its users or other participating businesses.
Where reasonably practicable, AnyExpat will seek to provide an opportunity to resolve a correctable issue.
AnyExpat may terminate a service where a serious breach occurs or where a material breach is not corrected within a reasonable period after notification.
The specific three-strike provisions relating to unauthorised external linking within AnyExpat communities are set out in Section 17.
23. Third-Party Services
AnyExpat may use third-party providers to operate parts of its services, including payment processing, hosting, communications and technical infrastructure.
AnyExpat is not responsible for independent products or services provided directly by third parties under a separate agreement between you and that third party.
24. Data and Privacy
Personal information will be handled in accordance with AnyExpat’s applicable Privacy Policy and data-protection obligations.
Where a service enables an enquiry or introduction between a user and a participating business, relevant information supplied by the user may be provided to that business for the purpose of responding to the enquiry.
Participating businesses are responsible for their subsequent handling of personal information they receive and for complying with applicable data-protection laws.
25. Availability of Services
AnyExpat will use reasonable efforts to operate and maintain its services.
From time to time, services may be unavailable or affected by maintenance, technical problems, upgrades, third-party systems or circumstances outside AnyExpat’s reasonable control.
AnyExpat may modify or improve its websites, platforms and services as they develop.
26. Responsibility and Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
AnyExpat is responsible for providing the applicable services in accordance with these Terms.
To the extent permitted by law, AnyExpat will not be responsible for indirect or consequential business losses arising from use of the service.
AnyExpat is not a party to property negotiations or transactions between Property Partners and prospective customers unless expressly agreed otherwise.
Property Partners and other participating businesses remain responsible for their own professional advice, representations, negotiations, contractual relationships and transactions with customers.
27. Changes to These Terms
AnyExpat may update these Terms from time to time to reflect changes to its services, legal requirements, payment arrangements or business operations.
The current version will be published on the AnyExpat website together with its latest update date.
Where a change materially affects an existing paid subscription, AnyExpat will take reasonable steps to provide appropriate notice where required.
Changes will not retrospectively alter a payment or specific commercial term already agreed for a completed transaction unless permitted by the applicable agreement or law.
28. Changes to Services
AnyExpat may develop, modify, replace or improve features and functionality within its services.
AnyExpat will seek to ensure that changes do not materially undermine the overall nature of a paid service during an existing paid subscription period.
29. Entire Agreement
These Terms, together with the commercial information presented and accepted during the relevant purchase or registration process and any expressly incorporated service-specific terms, constitute the agreement relating to the applicable AnyExpat service.
Any individually agreed written terms expressly accepted by AnyExpat will also form part of the agreement and will take precedence where they expressly vary these Terms.
30. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
31. No Waiver
If either party does not immediately enforce a right under these Terms, this does not mean that the right has been waived.
32. Transfer
You may not transfer your rights or obligations under an AnyExpat subscription to another organisation without AnyExpat’s prior agreement.
AnyExpat may transfer its rights and obligations as part of a legitimate transfer, restructuring or sale of the relevant business, provided this does not materially reduce your rights under an existing agreement.
33. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from or in connection with them, their subject matter or formation will be governed by the laws of Scotland, unless mandatory applicable law requires otherwise.
The courts of Scotland will have jurisdiction in relation to disputes or claims arising from or in connection with these Terms, subject to any mandatory jurisdictional rights that cannot lawfully be excluded.
