CHECKING THE DEED OF ORIGIN OF PROPERTY
When buying a property in Italy, one of the most important checks to be carried out to avoid unpleasant surprises is the “origin” of the property. It is necessary to reconstruct the steps that have led the seller to be the full owner of the property.
To carry out this verification it is necessary to request the deed of origin, which is the document (notarial deed, sentence, decree) that assigns to a person the ownership of the property.

Whoever sells a property does not have to necessarily have it purchased: he may have received it as a donation or he may have inherited it, from any will, from the acceptance of the inheritance or from the original title of purchase of the deceased.
The deed of origin, moreover, could be represented by a judicial measure. Moreover, the Courts can transfer the ownership of the real estate through decrees deriving from real estate enforcement proceedings.
The document contains three main pieces of information: – who is the owner of the property; – the title by which the owner owns the property; – any clauses of use: for example conditions, limitations, constraints, easements etc.
The deed of origin of a property is mandatory to enter into a deed of sale or a mortgage loan.
